Notice – Management of Applicant Data – Taleo

Please read this Notice carefully. By submitting application information at this website, you consent to Nielsen’s collection and use of Applicant Data as described below.

  1. About The Nielsen Company. Nielsen Holdings plc (NYSE: NLSN) is a global performance management company that provides a comprehensive understanding of what consumers Watch and Buy. Nielsen’s Watch segment provides media and advertising clients with Nielsen Total Audience measurement services across all devices where content, including video, audio and text, is consumed. The Buy segment offers consumer packaged goods manufacturers and retailers the industry’s only global view of retail performance measurement. By integrating data from its Watch and Buy segments and other data sources, Nielsen provides its clients with both world-class measurement as well as analytics that help improve performance.   2. Purpose and Function of Taleo. Taleo is a human resource recruiting software program hosted on servers owned by the Oracle Corp. Applicants can create a profile and submit their resume and application through Taleo’s software. Oracle is located within the United States and participates in the EU-US Privacy Shield framework initially certifying on 8/31/2016.
  3. Data collection. Your submission of your application and related data is entirely voluntary. As part of the application process, Nielsen will collect data about you, including what you submit on application forms, your resume and other documents. Such data may initially include, but is not limited to, your name, address, telephone, email address, date of birth, social security or other identifying number, gender, occupation, education level and income. If Nielsen considers your application or extends an offer of employment, Nielsen may collect certain additional data either directly from you or from third parties (e.g., background checks, where allowed by local law). Data about you that we receive from you or others in connection with your application is referred to in this Privacy Statement as “Applicant Data.”

    We may collect and retain Applicant Data manually or electronically, and electronic data collection may not always be obvious to you. For example, email servers may retain emails received and sent. When Applicant Data is collected on a Nielsen website, we may use cookie technology to facilitate your use of our online application processes. When you visit our site, your browser automatically sends us an Internet Protocol address and certain other data, including the type of browser you use. Our cookies on this site are used solely to facilitate your online experience, and are not used to make employment-related decisions. Our cookies on this site expire within 24 hours. You may choose to modify your Internet browser settings to decline our cookie, but that may hinder or prevent your use of our online employment application tools.

    Your use of the Taleo program is entirely voluntary, and requires entering data into the Taleo-hosted environment. Your data will be processed in and thereafter stored on a local server in an Oracle facility in the U.S. Applicant Data may be reviewed by recruiters located in all parts of the world; some recruiters are full-time Nielsen employees and some are outside contractors.

  4. Use of Applicant Data.

    Nielsen may use Applicant Data to communicate with you in writing or by telephone or online, to evaluate your application, to analyze Nielsen staffing needs and practices, or otherwise to efficiently manage the Nielsen hiring process and employee administration. We may combine Applicant Data with research tools and data from other sources.

  5. Accuracy of Applicant Data. From time to time, Nielsen may ask you to review and update the Applicant Data we hold about you.
  6. Right to Access Personal Data. You may access and correct your Applicant Data by logging into Taleo and updating it. You can also contact us at staffing@nielsen.com to receive more detailed information about the data gathered about you, the categories and purposes of processing of your data and to whom your data has been transmitted. If you have received a preliminary offer of employment, you can log in to verify your data, consent to a background verification, if applicable, and e-sign a disclosure. We are required by applicable laws to retain information relating to candidates applying for jobs. Applicant Data will be retained in accordance with local law. Nielsen may remove inactive Applicant Data from its database (including your CV/résumé), subject to Nielsen’s data retention obligations and policies and any applicable laws, or retain it for the purpose of considering whether your skills are suitable for other opportunities. Please retain your own copy of the personal information provided to us.
  7. Data disclosures. Applicant Data is controlled primarily (but not exclusively) by Human Resources Department staff, and may be stored electronically or in hard copy. Other staff involved in hiring or information management also may have access to some or all Applicant Data, as may senior management. To achieve the objectives described above, and because we are part of a larger group of companies operating internationally, we may from time to time make Applicant Data available to other companies within the Nielsen family of companies. Also, we may from time to time make Applicant Data available to legal and regulatory authorities (such as labor and tax authorities), to our accountants, auditors, lawyers and other outside professional advisers, and to parties providing products or services to us (such as IT systems suppliers, and human resources consultants). Notwithstanding any other provision of this Statement, we also may disclose Applicant Data to any third party when disclosure is required by law, or desirable to permit us to exercise our legal rights or take action regarding illegal activities, or to protect the safety of any person. If all or part of our company is sold, merged, or otherwise transferred to another entity, we may transfer Applicant Data as part of that transaction.
  8. Storage, transfers and security of Applicant Data. We may store Applicant Data for as long as needed for the purposes indicated in this Privacy Statement, but in any event not longer than permitted by local law from the date of collection unless you become employed by Nielsen, in which case a different retention period may apply. Records not specifically designated as Applicant Data may have different retention periods (e.g., email server records of emails received or sent). As stated above, Applicant Data are processed in and thereafter stored on a local server in an Oracle facility in the United States. We have in place certain security measures to protect the confidentiality of Applicant Data (such as firewalls to protect servers), but the storage and communication of personal data cannot always be completely secure.
  9. We do not knowingly collect application information from children under age 13.
  10. We may change this Careers Privacy Statement. This Careers Privacy Statement supersedes and replaces any other statement we may have made to you about Nielsen’s collection and use of Applicant Data. We reserve the right to update and make material changes to this Careers Privacy Statement and to our practices in handling Applicant Data to the extent permitted by applicable law. Data about you that we receive from you or others in connection with your application is referred to in this Privacy Statement as “Applicant Data.” Applicant Data may include Personal Data, which means any information relating to an identified or identifiable person.

  2. Data Controllers. The practices described in this Privacy Statement are undertaken by the Nielsen group of companies. As the controller of the Personal Data that you provide or that we process in connection with this site and your application, we are committed to protecting your privacy.   3. Data collection. Submission of your application and related Applicant Data is entirely voluntary. As part of the application process, Nielsen may collect the following data about you:
    • Data you submit. As part of the application process – either initially or after we have made you an offer of employment – you may submit your name, address, telephone number, email address, date of birth, social security or other national identification number, gender, current occupation, income, details about your education history, and other data included on employment related documents such as your resume or CV.
    • Data from third party sources.
      • Nielsen may collect certain additional data either directly from you or from third parties (e.g., through background checks, where allowed by local law) if Nielsen is considering your application or extends an offer of employment. In some countries a background check will be requested before an offer is finalized. Your consent will be requested separately for background screening in accordance with applicable law.
      • Nielsen may carry out education/degree verification and reference checks, but will only call former employers with your consent. These checks will be strictly limited to educational and professional information.
      • Nielsen may also carry out social media checks on profiles that are publicly viewable but only to the extent relevant for the performance of the job for which you are being considered.
    • Data collected automatically. We may automatically collect information about your device through your use of our site including Internet Protocol address, browser type, time and date of your visit to the site, and the webpage you visited immediately prior to this site.
    • Data collected via Cookies. We may use cookie technology to facilitate your use of our online employment application tools. The cookies on this site are used solely to facilitate your online experience, and are not used to make employment-related decisions. You may choose to modify your Internet browser settings to decline our cookies, but that may hinder or prevent your use of our online employment application tools.
  4. As part of your application, we may also ask you to participate in supplemental assessment activities in order for us to further evaluate your qualifications for the role to which you apply.  Information shared with Nielsen by our service providers when you access their services as part of the hiring process is considered Applicant Data and will be treated by Nielsen in accordance with this Privacy Statement. Please also review the Privacy Statements of our service providers to understand their data processing practices.
  5. Use of Applicant Data. Nielsen may use Applicant Data to communicate with you in writing, by telephone or via email to evaluate your application, analyze Nielsen staffing needs and practices, or otherwise efficiently manage the Nielsen hiring process and employee administration. We may combine Applicant Data with research tools and data from other sources as indicated in the “Data Collection” section of this Statement.
  6. Legal Basis for Processing – EEA Residents. Depending on your jurisdiction, local law may require us to state a legal basis for processing the Personal Data we collect about you in connection with this site. We will process the information you submit as part of your job application based on our legitimate interests. or the legitimate interests of certain third parties, provided that such processing shall not outweigh your rights and freedoms. In particular, we will process your personal data in reliance on a legitimate interest in order to carry out the job application process, as well as the effective and lawful operation of this site. We may have other legitimate interests and, if so, we will make clear what those interests are at the relevant point in time. By creating an account, you acknowledge Nielsen’s processing of your Personal Data for the purposes described in this Statement.  To the extent that we process any sensitive personal data relating to you, we will do so because either: (a) you have given us your explicit consent to process the information; (b) the processing is necessary for the establishment, exercise, or defense of legal claims; or (c) you have made the information manifestly public. In circumstances where we require your consent, we will notify you about the purposes and scope of processing of your Personal Data, and we will be processing your Personal Data based on the legal grounds of your explicit consent.
    • Legal Basis for Processing – Residents in Turkey. The legal basis for processing the Personal Data we collect about you in connection with this site are the grounds of such processing activities being necessary for our legitimate interests, provided that such processing shall not outweigh your rights and freedoms, that such processing activities are required for the formation and execution on a contract of employment, and that such processing is necessary for compliance with our legal obligations. In particular, we will process your personal data in reliance on a legitimate interest in order to carry out the job application process, as well as the effective and lawful operation of this site. We may have other legitimate interests and, if so, we will make clear what those interests are at the relevant point in time. Furthermore, as stated in this Statement, during the course of the job application process, there may be times when we must obtain your explicit consent so as to proceed with some procedures that require processing of your personal data for a number of purposes or for processing of your personal data of a sensitive nature. In such circumstances, should you provide the required consent having been first notified about the purposes and scope of processing of your Personal Data, we will also be processing your personal data based on the legal grounds of your explicit consent.

  7. Right to Access Personal Data. You may access and correct your Applicant Data at any time by logging into our recruitment platform and updating it. You may contact Nielsen at any time to request to see the information we hold about you, to request that it be corrected or updated, to request the details of parties to whom it has been made available, or withdraw your consent for us to process your data. Depending on your country of origin, you may have certain additional rights with respect to the personal data we hold about you. If you would like to review, correct, update, suppress or otherwise limit our use of your Personal Data, withdraw any consent you have given us to process your Personal Data (where applicable), or have further questions about how we use your Personal Data collected during the application process, please contact us. If you contact us as described above, we will make reasonable efforts to identify any data relating to you in order to act on your request.  If you reside in the EEA and believe Nielsen has not complied with privacy laws or the terms of this Statement, you may lodge a complaint with Nielsen’s Data Protection Officer by emailing privacy.department@Nielsen.com, or with the appropriate Data Protection Authority (“DPA”).     • Data Subject Rights – Residents of Turkey. As a data subject residing in Turkey, in addition to the rights stated above, the full set of rights with regard to your personal data as granted under the Turkish Data Protection Law numbered 6698 are as follows:
      • Learning whether your Personal Data is being processed,
      • Requesting information regarding the processing of your Personal Data,
      • Learning the purpose of the processing of your Personal Data and whether the data is being used in compliance with the stated purpose
      • Learning of the third parties to whom your data has been transferred to domestically or abroad,
      • Requesting rectification of the processed Personal Data that has been processed incompletely or inaccurately,
      • Requesting the erasure or destruction of your Personal Data in the situation that the purpose of processing no longer exists,
      • Requesting that the processes of correction, erasure or destruction carried out pursuant to the relevant legislation is notified to third parties to whom Personal Data has been transferred,
      • Objecting to a decision that impacts you negatively that have been reached as a result of analysis of your Personal Data through solely automatic means,
      • Demanding compensation for the damages that you have suffered as a result of unlawful processing of your Personal Data.

  8. When we share Applicant Data.
    • Within the Nielsen group of companies. To achieve the objectives described above, and because we are part of a larger group of companies operating internationally, we may from time to time make Applicant Data available to other companies within the Nielsen group of companies.
    • With Nielsen employees or recruiters. Applicant Data is controlled primarily (but not exclusively) by Nielsen Human Resources Department staff, and may be stored electronically or in hard copy. Other staff involved in hiring or information management also may have access to some or all Applicant Data, including senior management or outside recruiting services providers.
    • With Third-Party Service Providers. We will share Applicant Data with third parties that provide services to us, such as (but not limited to) HR recruiting software, ability testing, virtual video interviewing, website hosting, data analysis, infrastructure, IT services, customer service, email delivery, and auditing.
    • As required by law or regulatory authorities. We may from time to time make Applicant Data available to legal and regulatory authorities (such as labor and tax authorities), to our accountants, auditors, lawyers and other outside professional advisers.  We also may disclose Applicant Data to any third party when disclosure is required by law, or as needed to permit us to exercise our legal rights, take action regarding illegal activities, or to protect the safety of any person.
    • As part of a merger, sale, or transfer of assets. If all or part of our company is sold, merged, or otherwise transferred to another entity, we may transfer Applicant Data as part of that transaction.
  9. Retention of Applicant Data. We may store Applicant Data for as long as needed for the purposes indicated in this Privacy Statement (including for the purpose of considering whether your skills are suitable for other opportunities within Nielsen). In any event, we will not retain your Applicant Data longer than permitted by local law from the date of collection unless you become employed by Nielsen, in which case a different retention period may apply. Records not specifically designated as Applicant Data may have different retention periods (e.g., email server records of emails received or sent).
  10. Data Security and Transfers of Data. Nielsen maintains a global data security organisation that uses appropriate organisational, technical and administrative measures to protect your data while under our control.  We may store and process your data in your home country and/or we may transfer and export these data outside of the European Economic Area to any country where we have facilities or in which we engage service providers and processors, including the United States and India. The data protection laws of other countries may differ from those in your home country. When we transfer data, we ensure that we do so in compliance with applicable law for data transfer.
  11. Children. This site is not designed for or intentionally targeted at children under the age of 18, and we do not knowingly collect application Personal Data about anyone under the age of 18. If we become aware that we have collected Personal Data relating to a child, we will take reasonable steps to delete it.
  12. Updates to this Applicant Privacy Statement. This Privacy Statement replaces any other statement, whether written or oral, made to you about our practices with respect to Nielsen’s collection and use of Applicant personal data.
