Clear Decisions Privacy Notice

Nielsen cares about your privacy and wants you to be familiar with how we collect, use, and disclose data. This Privacy Notice covers the collection and use of information by the Clear Decisions tool (this “Tool”). The practices described in this Privacy Notice are undertaken by Nielsen entities operating together around the world. More information about the Nielsen group of companies can be found here. As the controller of the personal data that you provide us or that we collect or process in connection with this Tool, we are committed to protecting your privacy. By using this Site, you are subject to the terms and conditions of this Privacy Notice.

DATA THIS TOOL COLLECTS

Data Collected Automatically. We automatically collect certain data when you use the Tool, including data about your device such as your operating system; the date, time and frequency of your use of the Tool; and use of features that help us direct future software development and enhancements.

Data Collected from Google Drive. We will receive your Google account information (i.e., your user name and password) solely in order to allow you to upload and download files to and from your Google Drive account, using the Google Drive application programming interface (“API”). This information will be stored in encrypted form.

Contact Us. When you contact us, we may ask you to provide your first name and surname, your e-mail address, telephone number, company, job title, and relevant information to help us address your queries or comments. We will use this information in order to respond to you.

COOKIES AND OTHER INTERNET TECHNOLOGIES 

Cookies. Cookies are small text files downloaded by the Tool when accessing online data on Nielsen servers; they are used to maintain session state and connection to those servers. HOW WE USE THE DATA

In addition to the ways we use your data as described in this Notice, we may also use the data you provide us: 

  • To respond to your questions and requests.
  • To send you information about this Tool; changes to our terms, conditions, and policies; and/or other administrative information.
  • For our internal business purpose, such as data analysis, audits, developing new products, improving this Site and/or our services, identifying usage trends and determining the effectiveness of our communications.
  • For the purpose of processing and billing for the services we provide or for other purposes linked to this Site.

Data protection laws in certain jurisdictions require that we only collect and process personal data where we have a lawful basis. We will process your personal data for as long as we have a relevant legal basis to do so. Generally, this is in order to provide you with the contractual services you have requested from Nielsen (contractual necessity), or if you have provided us with consent to process your data for other purposes.

Where we process your information under the legal basis of legitimate interests, we make sure our activity is appropriately balanced by strong privacy protections designed to minimize the risks to data subjects.

WHEN WE SHARE YOUR DATA

In connection with one or more of the purposes outlined above, we may disclose your data to:

  • Other members of the Nielsen group of companies for the purposes described in this Privacy Notice.
  • Third parties that provide services to us, such as (but not limited to) website hosting, data analysis, infrastructure, IT services, customer service, billing, email delivery, and auditing. 
  • Relevant third parties as part of corporate transactions, such as a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceeding).
  • Other third parties as we believe to be necessary or appropriate: (a) under applicable law; (b) to comply with legal process; (c) to enforce our terms and conditions; (d) to protect our operations or those of any of our affiliates; (e) to protect our rights, privacy, safety, or property, and/or those of our affiliates, you, or others; and (f) to allow us to pursue available remedies or limit the damages that we may sustain.

We will not share your information with third parties in order to allow them to contact you for advertising purposes unless you have asked us to do so. We do not sell your personal data.

This Privacy Notice does not address, and we are not responsible for, the privacy practices of any third parties, including those that operate sites to which this Site links. The inclusion of a link on this Site does not imply that we or our affiliates endorse the practices of the linked site. 

DATA SECURITY

We make use of appropriate technical and organisational safety measures to protect your personal data under our control. Unfortunately, no data transmission over the internet or data storage system can be guaranteed to be 100% secure. If you feel that the security of any data that we hold about you, has been compromised, please immediately notify us of the problem by contacting us in accordance with the “Contacting Us” section below.

EXERCISING YOUR RIGHTS

You may have rights in relation to the personal data that we hold about you. If you wish to review the contact data or other information that we hold about you, want to have the information corrected, have it deleted, suppressed, otherwise limit our use of your data, or have any further questions about how we use your personal data, please submit a request here or contact us via email at privacy.department@nielsen.com. If you contact us as described above, we will make reasonable efforts to identify any data relating to you in order to act on your request. Please note that your request must relate to you or another person you have the authority to act upon. We will require a confirmation of your identification prior to providing information about the data we hold. If you are unable to provide sufficient information to prove your identification, we reserve the right to refuse your request for access to personal data. 

Additional information for users in the EU/EEA: 

Individuals that have questions or concerns about Nielsen’s collection and processing of personal data can contact our EU Data Protection Officer at privacy.department@nielsen.com.  Individuals that are dissatisfied with the way Nielsen has processed personal data or any privacy query or request that they have raised to us have the right to complain to the Supervisory Authority in their country of residence or the location where the issue that is the subject of the complaint occurred.  The contact details of all the EU national Supervisory Authorities can be found by visiting: EU National Data Protection Authorities website.

DATA RETENTION

We will retain your personal data only for those periods necessary to fulfill the various purposes outlined in this Privacy Notice unless a longer retention period is required by law.

USE OF THIS SITE BY CHILDREN

The Site is not intended for children, and we request that children not provide personal data through the Site. If we become aware that we have collected personal data from a child under the age of 13, we will delete that information from our records.

CROSS BORDER TRANSFERS

The information you provide or the data we collect via this Site may be stored and processed in any country where we or our service providers operate and/or have facilities. As a result, your personal data may be transferred to countries or regions without data protection or privacy laws similar to those in effect in your home country. SENSITIVE DATA 

We ask that you not send or share via this Site any of your sensitive personal data (e.g., information related to racial or ethnic origin, political opinions, religious or other beliefs, health, criminal background, trade union membership, or government-issued identification numbers). If we do receive any sensitive personal data about you, we will, where necessary, obtain your explicit consent to collect and use such information in accordance with applicable law.

UPDATES TO THIS PRIVACY NOTICE

We may make changes to this Privacy Notice from time to time. The “Effective Date” noted at the top of this page shows when this Privacy Notice was last revised. Any changes will become effective when we post the revised Privacy Notice on this Site. Your use of this Site is subject to the terms of the Privacy Notice in effect at the time of your visit.
