Privacy statement relating to market research activities in New Zealand

For decades, ACNielsen (NZ) ULC has set the standard for market and consumer insight research. Our insights are based on representative samples of the population and help our clients (e.g. manufacturers, retailers, non-profits and governments) learn about what consumers watch, buy, their preferences and behaviours. Your participation in our survey helps us create our consumer insight solutions. Your input into these decisions is important and the more people that participate, the more the results we obtain truly reflect the spectrum of New Zealand society.

We take your privacy very seriously. We have created this Privacy Statement to help answer questions you may have about how we protect and use your personal identifying information. Please note that this Privacy Statement applies only to your participation in our consumer research surveys, and not to any data collected by Nielsen digital measurement services or any Nielsen panels you participate in. Please consult your panel agreement or our digital measurement privacy policy for further details about other types of data collection.

Participation in our market research projects is voluntary. We protect the identities of our participants. We will not use your personal identifying information (or those of members of your household) to advertise, promote, or sell third-party goods or services directly to you or members of your household.

What information we collect

•    Information you give us. As part of this research survey, you provide us with information. This may include:

o    Personal identifying information, which means information by itself – like your first and last name, home postal address or personal email address – or in combination with other information, that could identify a specific individual.
o    Demographic information such as gender, marital status, occupation and other information.
o    Information in connection with your participation in surveys and/or studies. These surveys request additional information such as your behaviors and preferences and help us better understand consumer behavior, use, and trends. “Behavior data” is when, why or how you do things such as how frequently you shop for groceries, use your computer, TV or the Internet. “Preference data” means the choices you make such as which breakfast cereals you buy, which stations to listen to or watch, or websites you visit.
o    Any content or material you choose to submit, upload or transmit, including without limitation, photos, videos, images, or the likeness of the individual submitting the content in connection with your participation in market research activities.
o    You may be asked to voluntarily provide or disclose sensitive information. “Sensitive information” means personal identifying information that discloses or reveals health or medical conditions, biometric or genetic data, sexual orientation or sexual life, political opinions/views, race/ethnic origin, religious and philosophical beliefs and trade-union membership.

•    Information we get from other sources. We may receive additional information about you from other sources, including other Nielsen measurement products. This may include information such as what you watch or buy, and your exposure to advertising. We also may receive information about you from your panel membership provider. We obtain this information from many sources, including outside sources. These include, for example:

o    census data,
o    the manufacturers and sellers of the products you purchase or use,  
o    “loyalty” programs (like those that offer rewards and points),
o    organizations that collect online data,
o    data suppliers,
o    companies that combine purchase information, and
o    other entities that have a legal right to provide such information to us.

We may combine the information we obtain from you with information from these additional sources. We will use it only for the purposes described in this Privacy Statement. By participating in our research, you agree that we may obtain this information about you and combine it in this way.  

Online surveys and internet technologies

Cookies are small files that store certain data on a device or computer. We use both session and persistent cookies in connection with our surveys. Cookies, pixel tags, web beacons or similar technologies may be used on some of our website pages and HTML-formatted email messages to, among other things, manage studies and to enhance your experience as a participant. We may also use these technologies for security purposes, to facilitate navigation, to display information more effectively, and to better serve you with more tailored information, as well as for site administration purposes, e.g., to gather statistical information about the usage of our websites in order to continually improve the design and functionality, to understand how users use our websites, and to assist us with resolving questions regarding use of the websites. How we use the information we obtain

•    We use the information we collect to create a variety of research insights for our clients. In research in which the participants are intended to remain anonymous, we use tools and methods to make sure that there is no reasonable possibility of identifying an individual participant in the reports that we create for our clients. For example, we combine the responses we collect from you with the responses of others to produce “aggregated” reports. We also create scientific reports based upon modeled information. “Modeled information” is data we have developed based upon demographic and behavioral characteristics (like your gender, age, and purchasing habits to predict what people with similar or matching characteristics would buy. For instance, this allows advertisers to identify the likely audience for a marketing campaign.

•    We may use the information you give us to contact you. When we contact you – by phone, email, SMS, or postal mail depending on what information you provide to us – we will usually do so for one of the following reasons:

o    to respond to your inquiries;
o    to validate answers you gave;
o    to update our records to ensure your information is correct;
o    to send you information regarding your participation such as how to redeem rewards;
o    to provide notice regarding changes to our terms, conditions, and policies;
o    or to offer you expanded research opportunities through panels and surveys.

For instance, if our service will be temporarily suspended for maintenance, we might send you an email.  Generally, you may not opt out of these communications, which are not promotional in nature. From time to time, we may send you invitations to participate in surveys. These emails contain instructions on how to contact us if you wish to opt out of future communications of this type. By participating in our research, you agree to be contacted as described above.  

•    We may also use the information for business purposes, such as data analysis, audits, developing new products, enhancing our surveys, improving our services, identifying usage trends and determining the effectiveness of our communications.

If we combine non-personal information with personal identifying information, the combined information will be treated by us as personal identifying information as long as it is combined

When we share your information

We may share your personal identifying information:

•    With other members of the Nielsen family of companies for the purposes described in this Privacy Statement.
•    With third parties who provide services for us such as website application hosting; data analysis; infrastructure provision; IT services; email delivery service; auditing services; and reward, incentive, sweepstakes, and other similar services.
•    With other companies for the purposes of data processing or market research product development purposes. These companies are contractually required to keep this information confidential and secure and are not permitted to use this information for any other purpose except to carry out the services that they are performing for us.
•    To other companies, including clients, in accordance with market research guidelines.  If any such company receives your personal identifying information (whether provided by us to such company or collected by such company directly from you), such company will be bound to keep the information confidential and secure and use it only for research or statistical purposes.
•    In other ways for which we provide specific notice prior to, or at the time of initial collection.
•    To a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).
•    As we believe to be necessary or appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to requests from public and government authorities including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; or (g) to allow us to pursue available remedies or limit the damages that we may sustain.

Your access rights

While your information remains identifiable, you may generally gain access to personal identifiable information held by us, subject to some exceptions.  You may contact the Privacy Officer to update any personal identifiable information we hold about you or gain access to or request deletion of your personal identifiable information.  You will need to verify your identity and specify what information you require. If we cannot provide you with access to that information, we will provide you with written notice explaining the reasons for refusal.

If you believe that we have breached the New Zealand Information Privacy Principles or New Zealand’s market research industry’s code, you may complain to the Privacy Officer .  The Privacy Officer will investigate your complaint and advise you whether the complaint has been upheld and, if so, the action taken.

Security and transfers

We use reasonable organizational, technical and administrative measures to protect your personal identifying information under our control. We may store and process your personal identifying information in your home country and/or we may transfer and export this information outside of your home country to any country where we have facilities or in which we engage service providers and processors, including the United States and India. The data protection laws of other countries may differ from those in your home country. Please be aware that storage and communication of data cannot always be 100 percent secure.
